“According to the legal community on the March 26th, the Seoul Eastern District Court’s Civil Division 21 granted an injunction on the March 25th to suspend the disciplinary measures against figure skater “B” (Young You.)
“B” was accused of taking illicit photographs during a national team training camp in Italy last May that could potentially cause emotional discomfort to Haein Lee and showing those images to skater “A,” who was reportedly in a romantic relationship with Haein Lee at the time. This led to the suspension imposed by the KSU.
The court ruled that it is difficult to definitively conclude that “B”’s act of photographing Haein Lee’s body was intended to cause sexual humiliation or repulsion, leading to this determination. The court found that there was no evidence to support the claim that “B” had shown or shared the photos with skater “A.”
Additionally, the court considered a petition submitted by Haein Lee, affirming that “B” never shared the photos with anyone and stating that Haein Lee “did not experience sexual harassment.” This petition played a favorable role for “B.”
Because the court has suspended the enforcement of the disciplinary measure, “B” is now eligible to participate in the 2026 Milan–Cortina d’Ampezzo Winter Olympic national team selection event, expected to take place this December.
According to the KSU’s rules for selecting national team members, athletes who have been suspended for one year or more for misconduct related to sexual violence are disqualified from being part of the national team.
Under the previous disciplinary terms, even if “B”’s suspension period had ended in June next year, she would not have been eligible for national team selection. However, with the court’s injunction to suspend the effect of the disciplinary decision, “B” has recovered both her athlete status and her eligibility for national team selection.”
